Official Competition Rules
1. Competition Period
The Race to Save the Bears (the “Competition”) begins at 2:00 p.m. Eastern Time (“ET”) on October 6, 2009 and ends at 11:59 p.m. ET on November 12, 2009 (“Competition Period”).
2. Eligibility
This Competition is open only to legal residents of Canada (excluding Québec) who have reached the age of majority in their respective province or territory of residence at the time of entry. Residents of Québec, and officers, directors, employees and independent contractors of Humane Society International/Canada (“Sponsor”), Humane Society International (“HSI”), The Humane Society of the United States (“HSUS”), and their affiliates, professional fundraising agencies, and any individual or entity involved in the development, promotion, or execution of this Competition, and the immediate family members (defined as parents, siblings, children and spouses, regardless of where they reside) and household members (whether related or not) of each of the foregoing, are not eligible to enter or to win. Individual entrants only; no teams, groups or organizations. Competition is subject to all applicable national, provincial, territorial and local laws and regulations. Void where prohibited. Individuals who are not eligible to participate in the Competition may nevertheless use the link below to solicit donations, but are not eligible to win prizes.
3. How to Enter and Win
No purchase necessary. To enter the Competition, you must access the "Join" link provided at left and fill in the online entry form. A webpage (your “Donations Page”) will be set up for you upon processing of your online entry form. Limit: One (1) Donations Page per person. Once you become a competitor, and your Donations Page has been activated, you are ready to accumulate donations which will form your donation total (your “Donation Total”). Please note that donations submitted by you through your own Donations Page do not count toward your Donation Total. You can forward the details regarding your Donations Page to friends, family and others who will then be able to make donations to Sponsor by logging on to your Donations Page. In so doing, their donations would be supporting you in this Competition.
The thirteen (13) competitors who raise the highest Donation Totals during the Competition Period are eligible to win a prize. Prizes will be awarded in descending order of amount of Donation Total. For example, the Grand Prize will be awarded to entrant with the highest Donation Total, the second prize to the second highest Donation Total, and so on. See Rule 4 below for prize information. The chances of winning any prize are dependent on the number of competitors and the fundraising skills of the competitors used to achieve the highest Donation Totals.
You can track your Donations Total against those of other competitors on the main Competition webpage. Donation Totals may not be transferred, shared or pooled. Only donations that are made online will be eligible to count towards your Donation Total. Tax receipts for donations will not be issued. Please ensure that those wishing to make donations to support you in this Competition are aware of these restrictions. By inviting someone to your Donations Page, you represent and warrant that you have their permission to email or otherwise use the personal information of that person for this purpose.
Click here to enter. Before being declared a winner of any prize, competitors who are eligible to win prizes must complete and return to Sponsor by the deadline specified the Release Form described below in Rule 6.
4. Prizes
Grand Prize: There is one (1) Grand Prize available to be won, consisting of a two-night stay for the winner and one (1) guest at the Great Bear Lodge, in the spring of 2010. Specifically, the Grand Prize consists of: Floatplane transfers from Port Hardy (on northern Vancouver Island) to Great Bear Lodge; Two (2) nights standard accommodation (double occupancy); Three meals (including beverages) per day; Four (4) bear-viewing sessions in the Great Bear Rainforest, guided by wildlife biologists; and Winner’s choice of two (2) other activities offered at Great Bear Lodge during your stay (e.g. an interpretive rainforest walk or sea-kayaking). Prize does not include travel expenses to or from Port Hardy, British Columbia, which shall be the sole responsibility and expense of the winner. The approximate retail value of the Grand Prize is $4,450. The trip must be scheduled according to availability at Great Bear Nature Tours, and may be subject to black-out periods. Trip must be taken by October 31, 2011.
Second Prize: There is one (1) Second Prize available to be won, consisting of a photographic print entitled “Great Bear Guardian” signed by photographer Ian McAllister (unframed, measures 32 x 21.9 in.). The approximate retail value of the Second Prize is $600.
Third Prize: There is one (1) Third Prize available to be won, consisting of a Canon PowerShot A1100 IS 12.1 Megapixels digital camera. The approximate retail value of the Third Prize is $200.
Honourable Mention Prizes: There are ten (10) Honourable Mention Prizes available to be won, each consisting of a t-shirt printed with the Protect Bears and HSI Canada logos. The approximate retail value of each Honourable Mention Prize is $25.
General Prize Conditions: Prizes must be accepted as awarded, and are not transferable, redeemable or exchangeable, whether in cash or otherwise, except at Sponsor’s sole discretion. If for any reason the prize, or any element of a prize, cannot be awarded as described above, Sponsor reserves the right to substitute the prize, or any element of the prize, for another prize of equal or greater monetary value. Winners are responsible for any costs or expenses that are not specifically described above as included in the prize.
5. Ties, etc.
In the event of a tie among competitors who are otherwise eligible to win a prize, the winner will be determined by the largest single donation (in a single transaction) that one of the tie-breaking competitors was able to secure toward their Donation Total from any single donor. If a tie still exists, a winner will be determined by the total number of unique donors who made a donation toward their Donation Total. For clarity, a donor is considered to be one individual person regardless of how many donations he or she made on a competitor's Donations Page.
6. Winner Notification/Prize Claims
The eligible entrants will be confirmed by Sponsor on or about November 20, 2009 and will be notified by telephone and/or email by November 25, 2009. Before being declared a winner, each eligible competitor will be required to complete and return to Sponsor a Declaration and Liability and Publicity Release form (the “Release Form”), confirming compliance with these Official Competition Rules, acceptance of the prize as awarded, and releasing the Releasees (defined below) from any liability in relation to the Competition or the prize. The Release Form must be returned to Sponsor within thirty (30) days of attempted prize notification or the prize will be forfeited at Sponsor’s sole discretion and may be awarded to the next eligible competitor with the next highest Donation Total. In the event that an entrant fails to comply with these Official Competition Rules or declines the prize, or if a prize or prize claim notice is undeliverable, an alternate may be selected at Sponsor’s discretion, who will be the competitor with the next highest Donation Total.
7. Personal Information
By entering the Competition, competitors agree to the use of their personal information by Sponsor and its agents and representatives for the purpose of administering the Competition and fulfilling prizes. Your personal information will be maintained on servers located in Canada and the United States and will therefore be subject to Canadian and US law. Your username will also appear on the Donations Total tracker with your permission, if you are one of the leading fundraisers. If not, your name will be displayed as Bear Supporter. You may also choose to receive future emails from Sponsor about its activities and fundraising efforts by opting in at the time you set up your Donations Page. By accepting the prize, the winners each consent to Sponsor's use of his or her name, likeness, voice, and/or biographical information for promotional and other purposes without additional notice or compensation, and may be required to sign a document to this effect. 8. Limitations of Liability
By participating, entrant acknowledges compliance with these Official Competition Rules and agrees to release Sponsor, HSI, HSUS, their affiliates and related companies, and each of their respective officers, directors, employees, independent contractors, representatives, and agents ("Releasees") from and against any claim or cause of action arising out of participation in the Competition, or the receipt, redemption, or use of any prize, including any injuries or damages of any kind sustained in connection with the use, acceptance, possession of, or participation in, any prize.
Without limiting the generality of the foregoing, Releasees will not be liable for (a) any incomplete or inaccurate information, whether caused by any website users or by any equipment or programming associated with or utilized in the Competition, or by any technical or human error which may occur; (b) the theft, destruction, or unauthorized access to, or alteration of, entries or any website; (c) any problems with, or technical malfunctions of, telephone networks or lines, computer online systems, servers or providers, computer equipment, software, viruses, trojan horses or bugs; (d) any failure of any email to be received by or from Sponsor for any reason including but not limited to traffic congestion on the Internet or at any website or combination thereof; (e) damage to an entrant’s or other person’s system occasioned by participation or downloading of materials in this Competition; or (f) any late, lost, misdirected, damaged, garbled, or incomplete entries which will be deemed void.
9. Termination
If, for any reason, the Competition, including the online contest site, is not capable of running as planned, including disruptions caused by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other cause that corrupts, affects, or compromises the administration, security, fairness, integrity, proper conduct, or intended play of the Competition, Sponsor reserves the right at its sole discretion (a) to disqualify any individual it deems responsible, and (b) to cancel, terminate, modify, or suspend the Competition and award prizes as they would have been awarded had the Competition been completed in full as outlined in Rule 3.
10. Additional Terms
By entering, entrant agrees to accept and abide by these Official Competition Rules and the decisions of the Sponsor, which shall be final, binding and without appeal in all matters related to this Competition. All entries are the property of Sponsor and will not be returned. By entering the Competition, entrants represent that they have complied with the Official Competition Rules in all respects and have committed, and will commit, no fraud or deception in entering or participating in the Competition or claiming any prize. Potential winners and/or prize winners agree to return, immediately upon demand, any prize or the retail value of any prize that has been or may be awarded to them, if any material condition of these Official Competition Rules is breached.
WARNING: ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS COMPETITION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
